LK, I think you are misrepresenting the content of that article. This is not a piece of Canadian legislation, but a proposed trade agreement between a set of wealthy nations, of which Canada is a member.
See this wiki page for more information. We know very little about the agreement other than a leaked 4-page discussion paper produced by the US government. I take that discussion paper as the broad outlines of what the Bush administration would like the rules to be.
I have a pretty hard time believing that all these nations next month are going to agree to the provisions as written in the discussion paper.
