So there are now records that, after the fact, the Whitehouse tried to create rationale to justify Trump’s actions.

This sure seems like an acknowledgement of guilt.

The district court has ruled that McGhan must testify and the claims of immunity are invalid.

This is going to be one of those test of how far we’ve gone, though ordinary people will hardly notice and poll numbers aren’t going to change, unless some wise and outstanding leaders make hay with it.

Because there’s a good chance McGhan will shrug and say “make me” - or if not him, some other administration official.

It’s still got appeals to go through, so if he does testify at all it won’t be for months and the process will have moved on by then.

Though it is possible now he will choose to testify now that he has the cover of this ruling to defy the white house. Unlikely, but possible.

Ok, but this is actually a sub-optimal outcome.

The optimal outcome, if I can dream the impossible dream, is he is impeached, removed from office, and then thrown into federal prison. Also his wealth seized/wiped out and all his cronies/kids become social pariahs never to grace the television screen again.

I want his legacy destroyed and the Trump brand to become a scarlet letter.

Adam Schiff seems to endorse the theory that, since enforcing subpoenas would ultimately rely on John Roberts’ vote, it’s better to issue them in the Senate and get a quick decision from Roberts than to run the clock out chasing it in the courts. He also argues that there is already enough evidence of a crime that Roberts ought to rule that the fraud / crime exception to privilege has to be invoked.

Of course it’s very possible that Roberts would go all-in on defending the extreme privilege being claimed here, but he does have a history of trying to split the baby in half. I think he might enforce the subpoenas but not necessarily strike claims of privilege.
