Technical question for anyone who knows: when the President’s people say “we didn’t engage in blanket stonewalling on subpoenas but pointed out legal errors in them” WTF are they talking about? Is it the tired nonsense where they’re telling the House how to handle the impeachment investigation?

The president’s position, incredibly, is that if an ongoing oversight investigation begins to produce evidence that might result in impeachment, the committees conducting that investigation somehow lose their subpoena authority until the whole House declares a formal impeachment inquiry.

Bribery requires quid pro quo. Quid pro quo means not acting in the national interest. Dershowitz suggested that to a politician, furthering re-election is in the national interest. Therefore furthering re-election, by itself, should not be regarded as bribery.

The argument is flawed, similar to Costanza’s “It’s not a lie if you believe it”. And the argument only works for crimes that require quid pro quo. Presumably, that includes the abuse of power impeachment article. But not other crimes. For instance, shooting someone on 5th Ave. has no exception for acting in the national interest.
