But if that is the case, it is time to change how the supreme court is made up. Lifetime appointments? 9 members? Gone and gone.
I’d propose something like 18 year term limits, with a seat opening every 2 years. That means each presidential term has 2 appointments. If a justice dies before term ending, then an interim member is appointed to fill the rest of the term. Just take off the court as an election and political issue.
But court packing is easier, and more likely.
If you have the courts stacked 6-3, you’re not changing the rules. You’ve set the country on a dark path for the remainder of its now brief history.
The problem is that you have to amend the Constitution to get rid of lifetime appointments. Which will basically never happen.
The one thing that the Constitution doesn’t control is the number of justices.
