One would expect law professors to understand the context and limits of judicial temperament. A judge is required to be impartial on the bench and temperate in public affairs. But if you put a judge in the dock, expecting him to testify about himself, it obviously becomes a very different matter. A defendant can’t be impartial. He can be temperate, but he doesn’t have to be if it doesn’t benefit his defense.

That does not excuse a descent into partisan lunacy.

First off, this is a bullshit distinction. Temperament is temperament. Sure we have different expectations based on context, but the intensity of Kavanaugh’s intemperance last week was such that it blasted past all lines.

Second, even if your distinction is valid, Kavanugh was is “in the dock” as part of an inquiry into whether he is fit for the office of Justice. In that context, then Fuck Yes, his temperament matters.

Third, it’s not just temperament that’s at issue here, but also partisanship - blaming the Democrats and harshly lashing back at Democratic Senators, and it’s also believing in nonsensical unsubstantiated conspiracy theories without a single thread of evidence such as alleging the “Clintons” are somehow orchestrating this.

Kavanaugh’s display on Thursday was disqualifying on multiple levels.

Agreed, it’s a ridiculous assertion but it plays to the Fox News/trump crowd, and as we’ve seen, that strategy appears to have worked.
