One would expect law professors to understand the context and limits of judicial temperament. A judge is required to be impartial on the bench and temperate in public affairs. But if you put a judge in the dock, expecting him to testify about himself, it obviously becomes a very different matter. A defendant canât be impartial. He can be temperate, but he doesnât have to be if it doesnât benefit his defense.

First off, this is a bullshit distinction. Temperament is temperament. Sure we have different expectations based on context, but the intensity of Kavanaughâs intemperance last week was such that it blasted past all lines.
Second, even if your distinction is valid, Kavanugh was is âin the dockâ as part of an inquiry into whether he is fit for the office of Justice. In that context, then Fuck Yes, his temperament matters.
Third, itâs not just temperament thatâs at issue here, but also partisanship - blaming the Democrats and harshly lashing back at Democratic Senators, and itâs also believing in nonsensical unsubstantiated conspiracy theories without a single thread of evidence such as alleging the âClintonsâ are somehow orchestrating this.
Kavanaughâs display on Thursday was disqualifying on multiple levels.
