Ok: Clarence Thomas announces that he will retire. Did the GOP put him up to it? Nobody knows, but the media hails this is as a selfless act of statesmanship and reconciliation from the post-Trump conservatives, who deserve again to be take seriously. Pundits hammer home the point that now the court will now be restored to a 5-4 split. And since thatâs exactly where it would have been under Justice Garland, this is the necessary and proper resolution and Democrats are unreasonable to expect any more.

Democrats give up trying to expect any more. Plans to expand the SCOTUS are abandoned. Republicans are happy because they keep their 5-4 majority for a little longer. Thomas was going to retire anyway, but he doesnât tell anyone.

Even if none of that happens, I think itâs unlikely they will expand the SCOTUS. Biden has signaled as much.
âI would not get into court packing. We add three justicesânext time around we lose control, they add three justices. We begin to lose any credibility the court has at all.â
The above scenario is just a way to de-escalate so that everyone can claim victory. Which means at minimum itâs a feasible outcome.
