I honestly think it’s gonna go with less than 4 justices supporting this case.

The argument seemed to be VERY weak, regarding whether the plaintiffs even had standing at all. All the judges grilled them pretty hard on this, and they didn’t seem to have a real good story for how the plaintiffs are harmed by a rule that has no penalty.




Good to see that they are letting precedents stand, but I’m still certain they are going to turn back Roe v. Wade in the next term. It’s going to go back to the states.

I wouldn’t bet on it. I guess we’ll see.

I feel they know that doing so would potentially draw such outrage that it would result in a degradation of the opinion of the population of the supreme court.

They can get the same result by chipping away slowly at it, with less risk of a Dem Senate majority big enough to do a courtstack.

Can’t believe they ducked out on this gimme.

It was the easy “no standing” ruling. The court loves that one.

The argument from the scotus is basically, “you can’t sue Trump because Trump hasn’t even said what he’s going to do yet.”

And this is pretty reasonable, because until something is actually announced or implemented, there aren’t really any facts you can argue about in court.

The doctrine of standing can be abused but is also vital IMO, as we saw in the Texas case. The details matter and I haven’t studied this case in detail, but my sense is that this dispute isn’t really “ripe” yet so I’m not too worried about this punt, right now.

Trump’s admin is likely to try some shenanigans to rush this out and claim a “final result” but the opposition is ready to get back into court quickly, so again, I’m not too worried. It’s also possible that Trump’s admin simply won’t have the time/competence to do this in the first place, so the whole thing may be moot.

This is something that requires vigilance, but I’m not toooooo worried.

It’s also possible that nothing will happen and Biden will just reverse it anyway before it matters.

That said, it would’ve been nice to have a ruling for future horseshit, but I’m mostly fine with procedural details stalling things. It’s not a super time-sensitive issue, waiting a month isn’t likely to cause irreparable harm to people.
