I have to say that Senator Patrick Leahy is and sounds very old and it is not at all too soon for Justice Breyer to retire, conditional on the seating of his replacement. I wonder what he’s waiting on? 50 +1 is damned slim when a number of the 50 are octogenarians.

Anyway, Justices typically retire effective at the end of a session. So probably the earliest would be this summer.

SCOTUS decided that the city of Philadelphia cannot require adoption agencies to consider gay applicants as a condition of receiving public money.
Surprisingly, it was a 9-0 decision.

Well, lots of people made predictions about different things Barrett would do, and some of those predictions will be wrong, and some of them will be right, and I wonder if Scott Greenfield will make a victory lap around the right ones?

This is a far more positive view of the decision than I would go with, but they do it by basically ignoring the actual case and focusing on the precedent for the future.
We need either a new thread or to retitle this one. Blessedly none of us is “under Trump” at the moment.
