These district and circuit federal courts better enjoy their power while it lasts. It won’t be long before Trump has a Nazi in SCOTUS, and not long after that before there’s another two more.
I really need to donate to the ACLU. I have a feeling they will need all the money they can get these next 4 years

I’m a little confused on how they are set-up as an organization. I received a few e-mails that talked about the foundation and ACLU. One is tax deductible and the other is not. They say they have more flexibility with the funds for the one that is not.

Because they engage in politics, they cannot be tax exempt. They have far more freedom of movement, so to speak, by not going for non-profit status. That is the group in need of support. They aren’t beholden to regulations that could limit their engagements.

That makes sense, well sort of since the churches get a free pass on that stuff and still their status but anyway… so the group that defends people in court, that’s the foundation right, not really… politicizing?

The nonprofit is heavily restricted in their activities. The arm that is not registered as nonprofit is not beholden to those restrictions. They defend people in court, etc… with far more flexibility. They are the ones in need of support now. Trump will certainly crack down on nonprofits engaging in anything that whiffs of politics.
p.s. Churches are more complicated and can’t really be compared here.

Not exactly, the same line of IRS code that says charities can’t do it says churches can’t do it either, literally says charities and churches. What confused me specifically about the ACLU is I can’t tell which activities the foundation does vs the other business because the articles usually just say ACLU when there are really two parts of that organization.

The ACLU and the nonprofit ACLU Foundation both use donations to pay legal expenses for various court challenges.
The ACLU also uses money for lobbying, the ACLU Foundation can’t lobby.

Just to answer my own question for those who were wondering: Yes, foreigners can give a donation to the ACLU. I just went to their donation page and was able to change the country to Canada (amongst a list of all the other countries) and entered my address, which it accepted without any problems. At least now, when my kids ask what I did, I can point to my small effort as something I could do as someone who doesn’t live in the US.
