Sources are telling me that the Skadden response to the CIG motion to dismiss is dropping tomorrow, and that it’s basically a nuclear explosion, ahead of the judge’s Feb 9th ruling on the motion.

This would be very interesting to watch, as you both appear quite confident of you positions, and these are both polar opposite positions. But I would think it would need ground rules and set topics for discussion. But I think it would be very interesting to hear both views engage in conversation - not to “burn” one another, but possibly to present the two POVs that are currently having the conversation using The Cone of Silence…

I don’t know, Leonard doesn’t seem to think very highly of the lawsuit, but it will go to trial.

We don’t pay attention to him. As a backer, he already overplayed his hand a couple of weeks ago, which he walked back less than a week later admitting that he hastily jumped to conclusions in his original stream in which he said that the lawsuit had no merit, and that if he were the judge, that he would rule in favor of CIG. All without reading all the documents in the filing, let alone seeing the Skadden rebuttal which landed yesterday.

I shredded him on Twitter yesterday, ahead of his latest stream which I thought was a bit tempered.

There is a reason why an IP lawyer isn’t actively practicing, but is relying on Patreon and average of $50 per video.

I watched his stream just to get a lawyer type of position (even though Derek obviously doesn’t agree) and I thought it was interesting. I didn’t get the impression he doesn’t think very highly of the lawsuit but instead seemed to say that some of the claims seemed valid, one or two seemed pretty easy to get rid of in trial, and the rest seems like it will depend on how the jury or judge interprets certain clauses.

It seemed like his biggest disagreement it requires a really unique scenario to claim both copyright infringement and breach of contract at the same time, and breach of contract damages require you to demonstrate economic harm which may be difficult to show.

I also got the feeling when I read it myself that Crytek is also setting things up so they can get discovery to prove they actually haven’t moved to Lumberyard but don’t want to explicitly call that out yet until they have proof.

Yup, and Crytek is right, as Derek has demonstrated in some “disassembly” analysis he did a while back. Star Citizen still has calls to functions that do not exist in Lumberyard, but exist in CryEngine, which is pretty much a smoking gun.

Dude you need to relax on Leonard French. Who the fuck cares if another armchair lawyer (degree or otherwise, backer or otherwise) agrees or disagrees with you? Tweetstorming attempted take-downs is fucking pointless. All it does is create yourself another enemy you don’t need, paints a target on your back as someone that is desperately invested in tearing SC down anywhere and everywhere you can. The reality is none of us know how this is going to shake out and any amount of speculative lawyering is nothing more than that.

I mean that as friendly advice, btw (and I don’t so twitter so can’t post it there). You do you, concentrate your efforts on your analysis - right or wrong, it’s yours. Sure, maybe comment on others’ readings, but no need to go actually picking fights with them. It’s pointless.

Saw his videos, Leonard analysis is pretty good if you ask me, he seems fair and balanced, and your tweet is harsh, he didn’t deserve that.

He didn’t think cig would get away with a dismissal and does think there is breach of contract, but that damages might be small or hard to prove. Djiz

You watched the wrong video, then. You should watch the first one which I linked to, and which I based my opinions on. The SAME video that, less than a week later, he walked back EVERYTHING he previously said about the case having no merits, that CIG would win, that if he were the judge he would rule the MtD in favor of CIG - all without every reading the contract or the pleading in full. etc.

Unlike most, I tend to extensive research BEFORE I write. You should try it.

If a judge had a connection to this shit show in any way shape or form, being a backer or former backer, he’d recuse immediately.

We only say that because it makes those guys mad as hell. The issue is that once the judge shreds the CIG motion on Feb 9th, puts in a blender, and serves it to CIG, those guys are going to be all over the place attacking her, claiming she’s partial, doesn’t understand game development, is a Derek Smart stooge, a Goon etc. You know, all the things they’ve been shoving into Skadden’s Twitter feed since I dropped the lawsuit news on Dec 13th.
