A Star Citizen backer sued CIG/RSI for $4,500 in small claims court. Now has 07/13/18 court date.

While I have no confidence that he will prevail, if CIG doesn’t defend (they will) this, and they lose by default, it will cause them serious problems down the road because it will just set a precedent and open the flood gates for similar action.

My guess is that they are going to answer, then file a motion to dismiss due to the arbitration clause in the TOS. If that happens, then he will have to re-file an arbitration case where they are likely to win since it tends to favor corporations. If he goes that far, it will be very interesting to see their arguments. They’re going to have to convince the arbitrator that they have somehow satisfied their obligations to him, and delivered a product. Aside from them having to make that whole “it’s crowd-funding” argument. It’s going to be several shades of hilarious - and I can’t wait.

Since 2015 as I was tracking their various TOS changes, I had said that they were doing it in order to rip backers off by walking back various promises (refunds, financial accountability etc).

Here we are.

Streetroller, the guy was the subject of my refund debacle blog from 2016, also had filed a defective lawsuit in NJ earlier this year. That one was so defective, it didn’t survive a motion to dismiss this past April.

This Reddit thread we’ve been laughing all day, is an absolute Gold mine of Star Citizen hilarity.

I like the part where one backer trying to get a refund blamed me because he says some backers gave CIG money through “spite pledging”…because of me.

Most of those clowns are the SAME ones who were attacking us over this scam. Now they can’t get a refund, they’re pissed at the notion that I was right, and that CIG has literally FAILED to “win” a battle they stood NO chance of ever winning, as that would imply shipping a GAME

Meanwhile, this one thinks he’s totally getting a $10K refund.

Between this thread and the Fallout 76 thread I am overdosing on schadenfreude.

30 some odd days turn around on a small claims filing - that’s pretty speedy.

It’s going to get tossed, as it stands 0% chance of surviving a motion to dismiss due to the fact that the TOS has an arbitration clause in it. OSC said it best here and here.

That said, I gave $500 to Shroud of the Avatar and that game is apparently pseudo-out and I can’t be bothered to figure it out until I get my cloth map. And I’m finally playing my $1000 Pillars of Eternity. So I am a friend to gaming dreams.

In that same broadcast, there were so many revelations - mostly of defeat and that I was right about the project - that you have to watch the whole thing to fully grasp the gravity of it all. He also basically said that the project, 6 years and $190M later, is “a bid of a mess”.

He has a doctorate btw, and is one of the best. He’s being replaced by a jnr dev (Dave Colson) who’s only worked on basic FPS games.
