If it were truly false, I believe we would be seeing slander lawsuits from the Trump camp. The NYT piece has 20+ documented Republicans on record, making it easily defensible in court. Most of the sources are anonymous, but NYT editors require that the anonymous sources be vetted by the editors for a piece to be published. The only way I see this story getting printed, especially given Trump’s history of litigation, is if the editors felt the story was air-tight.
So while it’s true that you can’t just print anything you want (out-right lies can be litigated against), this doesn’t appear to be one of those cases.
Technically, it wouldn’t be slander. It’d be libel.
To be clear, having a source on the record doesn’t make it not libel. It still has to be true*. But it makes it a lot easier to defend a libel claim.
- Actually, in these circumstances, in the US, it just has to be not maliciously false. But the larger point still stands. You can libel a public figure with on the record sources.
