To be fair they haven’t convicted and sentenced her, only that there is no limit to the extend of punishment they can threaten her with - which is just as bad.

Not defending it in any way, to be clear, just explaining the origins. It was a law written in 1990 to target gang leadership and get them off the streets permanently. Not that it was a good law to begin with, but it’s being horribly abused in this situation… as is typical.

Such as is the case with all bad laws, which is why it’s important to always think of possible unintended consequences of giving the government power.
Laws should be as limited and specific as possible.
