Yes, you’re right that they aren’t afraid of banning it. I just don’t think they actually want to ban it. I think it’s probably better for them to have a patchwork of different laws in different states, and an open question about how the Court will decide the matter over time, so that they can leverage the issue as they have been doing.

This kind of small time hustling by state reps is unfortunately common. I don’t think this is a valid condemnation of the GOP as much as it illustrates that the US has literally thousands of state reps/senators across 50 states and a certain percentage of them will be bad apples. State legislator, especially in red states, is a job that pays about poverty level wages. So it’s a job only for those independently wealthy or those with the political acumen to grift some favors along the way.

They really do love the poorly educated.
