I’m much less familiar with US court procedure than I am with UK, but it seems like it would be extremely unusual for them not to be able to respond. The only thing I can think of that might be unusual about this is the length, and at least by civil litigation standards 40 pages isn’t particularly long.

From a look at the notice it’s a request to file a response of up to 40 pages. The phrasing of that tweet made it sound like they had a 40 page response ready to go.
