How is it possible that his attorneys haven’t succeeded in disabusing him of the notion that a trademark automatically gives one exclusive rights to any word or short-phrase that is “strongly associated” with the mark.
Facial tissues are so strongly associated with the Kleenex trademark it’s become a generic term for the product, that doesn’t mean the holders of the Kleenex mark own the term facial tissue. Coke is so synonymous with colas, and even with soda in general, a entire region of the US calls every soda a “coke”, this does not mean the coca-cola company own the rights to the words “cola” or “soda”.

Yes, that’s exactly backwards of how things go, unless they make sure their brand is distinct from the commodity, it loses protection - not that that is relevant to the Star Control trademark, just indicative of the nonsense of the argument.

This news is kind of anticlimactic. I am disappointed with Derek.
Derek made it sound like Brad was going to pull something shitty, so this doesn’t seem to be related to what he was hinting at (assuming it happens).
I love the fact that Brad presented a letter from a USPTO reviewer asking him for clarification regarding his request as an official defense of his entire concept of trademark and copyright.
The guy was just asking for more info.
I mean he can qualify but this strikes me as exactly what Derek would be hinting at as he gives the impression he thinks we’d all start crying if the game got put back up on Steam and GoG. It als strikes me that one of his inside sources is definitely Brad.
It can’t be what Derek was referring to, as SC:O was already back on Steam when he started with that whole spiel about earth-shattering news.
