Barr’s DOJ now declining to comply with a court order to turn over all recordings / transcripts of Flynn’s calls with Kislyak. Says none of them are relevant and that the government isn’t relying on any of them in the question of Flynn’s sentence.

It’s the Flynn sentencing.
This is a response to Judge Sullivan, who ordered the government to turn over all recordings / transcripts of Flynn’s conversations with Russians. The government has not done so; they say those calls aren’t relevant to sentencing. My impression is that Sullivan has wanted to throw the book at Flynn and wants the ammunition to do it.
Also, the voice mail Trump’s attorney left for Flynn’s attorney is unbelievable. Any jury would find it an attempt to obstruct.
Edit: It’s also possible that Sullivan is trying to use the sentencing hearing to publicly expose more wrongdoing by more bad actors.

It doesn’t really matter. It’s the judge who decides what is relevant, not the prosecution. When he orders them to turn over stuff, they turn it over. If it’s not relevant, he sets it aside. That’s how it works. Some of the lawyers reporting on this say they’ve never seen the government respond to a court order this way before.
These guys are basically in contempt of court. It’s just a question of if the judge wants to treat it that way, and he’s been pretty hostile to the government through the entire sentencing process.
A Judge who is not cleared for Top Secret and above classified information (assuming the Counter-Intelligence investigation is ongoing) probably can’t (IANAL). That’s why we have FISA courts.
Maybe, but their filing doesn’t say he can’t have it because it’s classified. It says he doesn’t need it.
Edit: Actually, this is wrong, sorry. The judge has already read all these transcripts. His order was that they be made public. The government complied WRT the one voice mail recording already public via the Mueller report and ignored the rest of the order. It’s possible there is a sealed filing related to the others.

That’s really crazy talk by Dershowitz. It is not like the Senate is going to ask for unanimous consent that Trump is impeached. There will be trial and if by some miracle he gets impeached. Trump’s lawsuit would get laughed out of every single federal court.
So the Chief Justice is going to hear a case about a trial he ran? That seems…odd.
