Same post where we assured that investigations into 2016 Russian interference and the Trump campaign were going to return indictments for key IC members shortly.

Key differences:

  1. Different judge,
  2. Flynn wasn’t convicted by a jury trial, but instead pleaded guilty and accepted a plea deal, and
  3. Has managed to do pretty much everything in his power to piss off the judge presiding on the case.

As Ken White has pointed out, Flynn’s plea deal was probably such that had he simply acted contrite and accepting, he likely would’ve gotten away with probation or a suspended sentence and served no time.

His new counsel’s continued antagonistic attitude regarding the plea deal – while not making any motion to change it – may mean that Flynn managed to turn that probation/suspended sentence into a few months of actual jail time.

You can’t be this dumb. But you can be this arrogant. Rudy back in Ukraine talking to all the people that got him and Trump in this mess in the first place:

Well, it honestly is pretty harsh, considering it’s the result of a guilty plea to lying to the FBI in a deposition, where the lie was discovered pretty quickly and didn’t have material impact of a lot of danger – they weren’t looking for a serial killer and Michael Flynn’s lies sidetracked them for months or anything like that. This was pretty mild stuff overall that he was charged on, and it was followed up by at least a modicum of cooperation.

Again, I’m going to defer to the guy who was a federal prosecutor here (Ken White) who said that Flynn was likely not looking at any incarceration time at all by normal sentencing guidelines. And now he is. I mean, what are they supposed to do, send Flynn to jail for years because he’s kind of a disagreeable moron?

Well, that’s the rub, right? You say Flynn is (probably) getting punished correctly for his crime, and other people want him and his fellow cronies to suffer for the overall sin of being a Trump crony and dirtbag.

You’re both correct, but one side is going to be massively disappointed with a few weeks or months of jail for Flynn. There’s punishment, and there’s punishment.

A short sentence like that is a badge of honor for shitty political animals. It’s the “they couldn’t get me on anything real, so they made shit up, right boys?” result. If I went to jail for a few weeks, it would massively suck for me, but it wouldn’t be life-ruining. For Flynn, I imagine the lawyers’ fees are the most punishing thing about this ordeal.

We do not have any federal laws or statutes against being a douche and dirtbag. Nor do we have any against douchey people freely associating with, commiserating and supporting other douches and dirtbags. It isn’t a thing, and thank goodness we live in a country where you can say some pretty odious and ridiculous bullshit and not be in fear of being jailed for it.

If the government thinks that the association of douchey cronies with another head dirtbag is in service of criminal planning or enterprises, then they issue a criminal conspiracy charge. If they don’t find that such a charge is warranted, then they don’t charge that. Here, they haven’t made such a charge against Flynn.
