I don’t know NY law, but very state with income tax I’ve lived in has calculated income tax as a percentage of federal income tax, which of course means global transactions are certainly a factor.

Interesting that one of the judges pressed the point with Vance’s lawyer that enforcement of the subpoena has not been stayed. The court stayed dismissal of Trump’s challenge but did not stay enforcement of the subpoena, and Vance can enforce the subpoena any time he wants.

I didn’t quite get that last bit. They’ll present arguments on Tuesday about whether there is or is not a stay on delivering the returns?

Trump’s lawyer put his foot in his mouth trying to play Jim Jordan, but backed down once Loheir focused on him. If nothing else it was fun to hear him start stuttering and being nervous, where before he’d been the calm and collected guy.

Basically no one had the actual paperwork of what the previous order was, so they’ll have to hunt it down and go from there is what I gathered.

Trump’s people said one thing. The DA said something else. The Court was basically “fuck if we remember, someone go look it up”.

Stays the dismissal order and judgment, doesn’t say anything about enforcement of the subpoena. Though maybe that is implied by staying the judgment.

Trump’s attorney would have been better served to just stand up and say “I’ve got nothing, your honor.”

Sounds like things are getting a bit wild in the Flynn hearing today.

Sullivan is grilling Flynn’s attorney on conversations / communications she has had with Barr or Trump about the Flynn case. Apparently at one point she tries to claim executive privilege lol.

Executive privilege and attorney-client privilege aren’t working, so now she’s pleading white privilege.

There are two different statements.

  • She asked Trump not to pardon Flynn

  • She had nothing to do with the controversial DoJ decision to try to dismiss the case

The latter DoJ decision is under heavy scrutiny. A request to pardon (or not) is fairly innocuous.
