I think Barr just argued that Martha Stewart (and anyone else accused of conduct interfering with a criminal investigation that itself never resulted in charges for the original act) should never have been jailed.
I trust that all federal agencies will start following this doctrine immediately. They can call it the Barr “yeahbut” policy.
