This link got me my 2nd ban. I protested the ban, was told I was bullying the other poster (who was repeatedly calling me a libtard). Since this 2nd ban lifted a few days ago, I’ve reported every instance of the use of the word libtard I’ve seen, and every single response from FB has been, “Nope, doesn’t violate our community standards.”

Since he appears to have died as a result of being sprayed with bear spray (wth?) I’m doubtful that anybody will be convicted of anything serious. Here’s hoping that they do though.
I’m pretty sure felony murder applies. These guys (along with others) assaulted a police officer who later died as a result. They’re all culpable for the death. I would be very surprised if a federal prosecutor didn’t want to take that approach.

I have mixed feelings about this. On the one hand, it would be cool if these particular individuals suffered some serious consequences. On the other, felony murder is pretty much bullshit and the source of a lot o injustice.
I don’t understand the term “felony murder.” Aren’t all murders felonies?
I gather it’s a “term of art” as they say, but it sounds redundant to my ear.
Each state (as well as the feds) have their own definitions of murder, and the various tiers of murder. It does indeed get horribly confusing.
I would think that unless they can prove the guys planned to kill somebody OR they can prove the murder was committed during the act of a felony (which is what I assume felony murder means), the best they can hope for would be something akin to Depraved Indifference.

From what I understand, felony murder basically means someone dies as a result (or during the course) of someone committing a felony. It doesn’t require an intent to kill whereas a murder charge does.
IANAL and don’t know if this applies, but I’m thinking something like: I rob a bank and don’t have an intent to kill anybody, but some poor guy has a heart attack and dies as a result of the robbery. I’m liable for felony murder even if I didn’t go in there with the intent to kill the guy.
