An excellent point. Trumpists like to pretend we don’t have the whole event on video. Babbit was actively trying to crawl through a smashed window to the chambers along with a gigantic mob of people who had broken into the Capitol Building that were chanting things about murdering people who were in the very next room. There was no way to know whether she was armed or what her intent was.
There is an active attempt by the Right to gaslight everyone else into thinking this was something else. But we know better because it’s right there on film.

It is a reasonable defense and likely to succeed, but that doesn’t mean you wont be in court for years even if you win.
The idea behind Qualified Immunity is that you can’t take cops to court every time they do their job, because then there wouldn’t be any cops or firefighters because they’d all be wrung dry by non-stop lawsuits.
Of course the idea that you can’t say, sue a fireman for breaking down your door to rescue you from a house fire and the reality of you not being able to sue a cop for beating your dog to death by slamming it into his police car by it’s leg because he felt like it is a whole other ball of wax.

For AOC to be comparable she’d have to be advocating for Maoism and struggle sessions.
