Did you know there's a game called Warzone that's not a Call of Duty battle royale mode? It's a turn-based strategy game available on mobile platforms and PC browsers that was developed largely by one person and launched in 2017, years before Call of Duty took the name
Activision’s Call of Duty: Warzone could not be more different from
Defendant’s game, a low-budget, niche virtual board game like Hasbro’s Risk where players take turns moving numbers (representing “armies”) across a map of the world. Indeed, it is inconceivable that any member of the public could confuse the two products or believe that they are affiliated with or related to each other.
This is, I am 100% sure, the exact opposite stance of the one they would take should the timeline be reversed.
