An interesting historical idea:

The chairman of the House Committee on the Judiciary faced a vexing problem: Pressure for impeachment was building, but while lots of evidence against the president was public, key pieces of it were not. They were, rather, in the hands of a special prosecutor, who didn’t work for Congress. The prosecutor’s job was to prosecute crimes, not to evaluate the president’s fitness for office. That latter job lay with the chairman and his committee, who didn’t have access to the prosecutor’s evidence. So the House judiciary committee chairman wrote a letter requesting that the evidence be turned over…

…Rodino’s course suggests a way forward for Nadler that is worth serious consideration. It boils down to this: If Nadler and his committee want the evidence in the hands of Special Counsel Robert Mueller that is relevant to their performance of their own constitutional function, they should start by formally asking Mueller to refer it to them.

Imagine you are Donald Trump.

You’re being investigated by the FBI, the SDNY, the NY State Tax Authority and a special counsel. The White House Lawyer has flipped. Your own lawyer, too, along with the Trump Org CFO and a dozen other people. Every aspect of your life and business past is under multiple microscopes. Oh, and you started a fight with the intelligence community, who think you might be a spy.

Are you clean? Have you always colored inside the lines? Is there nothing to find?

The skeletons are going to be found. If you know this… what do you do? Are you ready for bankruptcy and maybe criminal prosecution the day you leave office? No? How do you stop that, then?

(This worries me)

Retire to a lovely golden estate somewhere near Kiev?

A couple of things that occur to me:

  1. Mueller appears to be delegating stuff to the SDNY for reals now, which is something folks like Marcy Wheeler for a while have said is likely to happen.

  2. This feels like a pretty hefty set of subpoenas and potential indictments here. Like, substantial stuff.

  3. I Mueller is handing something of this much weight off to the SDNY…

And the House hasn’t even got started yet with their investigations into the crimes he has committed while in office after the election.
